In the U.S., elementary, secondary, and post-secondary schools must protect the privacy of students’ education records. The Family Educational Rights and Privacy Act (FERPA) was originally designed to protect students’ Personally Identifiable Information (PII) from unauthorized access or disclosure. FERPA has been amended to expand the definition of “school officials,” giving commercial companies, like Google, access to education records and other student PII. In 2011, FERPA was again modified to allow government authorities to access student records.

The Children’s Online Privacy Protection Act (COPPA) applies to online collection of personal information from children under 13. Commercial website operators and online services directed to children under 13 cannot collect PII from children under 13—knowingly or even unknowingly.

However, with BYOD programs, 1:1 computing initiatives, and a growing reliance on online data sources and websites, educators and administrator can potentially—and unintentionally—share private student data in just minutes. Many online sites now shift accountability for COPPA to the teacher or school district. And second-party data mining is quickly becoming a serious concern with student data being stored in the cloud.
